INDEMNIFICATION (MASTERING AND PRODUCTION)

By purchasing audio production services listed and sold by A-VOID.AUDIO at a-void.audio or www.avoidaudio.com, you automatically become bound to the terms of the following Indemnification Agreement:

A-VOID_AUDIO LLC has no liability for any copyright infringement. Customer shall indemnify, hold harmless and defend A-VOID_AUDIO LLC from and against any and all liability, damages, costs, and expenses, including, but not limited to, defense costs and attorneys' fees, for or by reason of any actual or alleged infringement of any third party's patent or copyright, arising from or related to the operation and utilization of customer’s work under this clause.

Customer assumes the responsibility for any legal consequences caused by their acts or warranties. A-VOID_AUDIO LLC has transferred all legal risk and responsibility of obtaining proper clearances and licenses to the customer and therefor is not responsible or liable for any legal action if the customer doesn’t attain proper clearances and licenses. A-VOID_AUDIO LLC is not legally responsible for any licenses and/or clearances and transferred the risk to the customer.

WARRANTY (HARDWARE)

All A-VOID.AUDIO branded equipment designed and built by A-VOID_AUDIO LLC is covered by a limited warranty against defects in materials and workmanship for a period of 90 days from date the unit is delivered to the original purchaser only. Shipping and repair costs will be covered by A-VOID.AUDIO within the 90 day period. Once outside the 90 day period, we will provide recommendations for repair technicians and the necessary documentation of repair. Cost of shipping and repair outside the 90 day warranty period will NOT be covered by A-VOID.AUDIO.

TERMS OF USE (SAMPLES & IR)

A-VOID.AUDIO samples, libraries, and presets may only be used pursuant to the terms and conditions enforced by A-VOID.AUDIO LLC. By purchasing products sold by A-VOID.AUDIO at a-void.audio, www.avoidaudio.com, or any other retailer, you automatically become bound to the terms of the following License Agreement:


All sounds and/or sound libraries purchased from A-VOID_AUDIO LLC. are licensed, not sold, to you by A-VOID_AUDIO LLC. A-VOID_AUDIO LLC is the exclusive copyright holder and licensor of all sounds and/or sound libraries purchased from A-VOID_AUDIO LLC websites. By purchasing sounds from A-VOID_AUDIO LLC, you are granted a non-exclusive license to use and incorporate A-VOID.AUDIO samples, loops and sounds in sync and within audio, visual, or multimedia productions and compositions. Audio, visual, and multimedia productions and compositions that qualify include film productions, television programs, radio/tv advertisements, website media, video game production, business presentations, album productions, artist promotions, and soundtracks – royalty free.

A-VOID.AUDIO products CAN NOT be used in any productions or compositions for any Sound and/or Loop libraries whatsoever. We take this very seriously and will use the full extent of the law to enforce this. 


Following these guidelines entitles you, the licensee, to use A-VOID_AUDIO LLC sound libraries without additional royalties, license fees, or any other fees due to A-VOID_AUDIO LLC. You may not distribute, sell, rent, lease, sublicense, assign, or otherwise transfer any of A-VOID_AUDIO LLC sounds except as incorporated in an audio, visual, or multimedia production. You may not distribute A-VOID.AUDIO sounds, samples and loops, either in native format or reformatted, filtered, re-synthesized or otherwise edited, for use as sounds, layered tracks, samples, multi-samples, programs or patches in a sampler, sample playback unit, website, compact disc, DVD, or computer. You may not distribute A-VOID.AUDIO samples independently of an audio, visual, or multimedia production. Additionally, you may not use A-VOID.AUDIO sound/loop products for the promotion and/or production of any competing products or services.


As a purchaser of product and bound to A-VOID_AUDIO LLC Terms, you agree all information you provide to A-VOID_AUDIO LLC is completely accurate. You will not disclose passwords or login information used in accessing any area of the a-void.audio or www.avoidaudio.com website to any other party and will respect A-VOID.AUDIO brand by truthfully holding such information as exclusive and confidential. You agree to exercise due diligence and maintain strict safeguards on all sound libraries purchased from A-VOID_AUDIO LLC to prevent unauthorized use or distribution thereof.

If you become aware of any unauthorized use or distribution of A-VOID.AUDIO (A-VOID_AUDIO LLC property), you shall immediately notify A-VOID_AUDIO LLC via email at info@a-void.audio.

PRIVACY POLICY

The following privacy policy describes the data collected and/or processed while you use our Site (a-void.audio and www.avoidaudio.com) and how your personal data is protected. For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

This policy also outlines your rights you have relating to your personal data and how you can reach out to A-VOID.AUDIO at anytime with any questions, concerns or general inquiries relating to your data.

A-VOID.AUDIO LLC is responsible for processing your personal data and your consent is the lawful basis upon which we process and store your personal data.

WHAT DATA WE COLLECT

A-VOID.AUDIO may ask you for certain personal data to provide you with our products, free downloads or updates. Some examples of this are when you make a purchase, opt-in for emails, contact our support team, create a new account or download free samples and IR’s.  The data we collect may include your contact information including name, email, phone number and billing (or shipping) address, login and account information, including username, password and/or unique user ID number.

HOW WE USE YOUR DATA

  • Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.

  • Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites. If you are an EEA resident, the legal basis for these data processing activities is our legitimate interest in selling our products, according to Art. 6 (1) (f) GDPR.

  • Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately. If you are an EEA resident, the legal basis for these data processing activities is our legitimate interest in keeping our website secure for you and other customers, according to Art. 6 (1) (f) GDPR.

  • Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you according to Art. 6 (1) (f) GDPR.

We will not, for any reason, release any of your personal information to third parties. All information given to us by our customers is used exclusively by A-VOID_AUDIO LLC.

It is widely acknowledged that no website, database or system is completely secure. In order to keep your data safe, consider taking steps to protect your personal information against unauthorized use or abuse.

We retain your personal data for as long as necessary to fulfill the purposes for which we collect it, except if required otherwise by law.

You may have the right to request: (i) access to your personal data we have collected; (ii) updating or correction of your personal data if it is inaccurate or incomplete; or (iii) full deletion of your personal data. You may also have the right to object to the processing of your personal data on compelling legitimate grounds relating to your particular circumstances. Where we have obtained your consent for the processing of your personal data, you have the right to withdraw your consent at any time.
